1About Babypedia

Babypedia is a trilingual (Sinhala, Tamil, English) mobile application developed and operated by Hemas Consumer Brands, a division of Hemas Holdings PLC, under the Baby Cheramy brand. The App is designed for expectant mothers and parents of children up to two years of age in Sri Lanka.

The App offers pregnancy tracking, parenting guidance, baby health tools, nutritional information, community features, and product recommendations — all localised for Sri Lankan families. A Content Management Portal supports the delivery of articles, videos, and dynamic content within the App.

2Acceptance of Terms

By creating an account or using the App, you confirm that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You have read, understood, and agree to these Terms of Use, the Data Protection Notice, and the Cookie and Tracking Notice.
• The information you provide during registration and use is accurate and up to date.
• By providing data related to a child, you represent and warrant that you are the parent or legal guardian of that child and have the legal authority to share such information.

We reserve the right to update these Terms at any time. When material changes are made, we will notify you through the App or your registered contact channel. Continued use of the App after notification constitutes acceptance of the revised Terms.

3Account Registration & User Responsibilities

To access personalised features, you must register an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Keeping your profile information current and accurate.
• Notifying us promptly if you suspect unauthorised access to your account.

We reserve the right to suspend or terminate accounts where we have reason to believe these responsibilities have not been met, or where there is suspected misuse of the App.

4Health Information — Important Disclaimer

Babypedia is a wellness tool and is not intended to be used as a medical device for the diagnosis, cure, mitigation, or prevention of any disease or condition. Babypedia provides general health, pregnancy, and parenting information intended for awareness purposes only. The content within this App:

• Does not constitute medical advice, diagnosis, or treatment.
• Does not replace consultation with a qualified healthcare professional.
• May not be applicable to your individual health circumstances.

Always seek the advice of your doctor, midwife, or other qualified health provider with any questions you may have regarding a medical condition or the health of your child. Never disregard professional medical advice or delay seeking it because of information you have read or accessed through this App.

In the event of a medical emergency, contact emergency services immediately.

5Permitted Use & Restrictions

5.1 Permitted use

The App is made available to you for personal, non-commercial use to support your pregnancy and parenting journey. You may use the App to access health content, utilise tracking tools, engage with community features, and access relevant product information.

5.2 Restrictions

You must not:

• Copy, reproduce, distribute, or commercially exploit any content from the App without our prior written consent.
• Engage in data mining, scraping, or any automated data extraction from the App.
• Upload or share any content that is unlawful, harmful, defamatory, misleading, or infringes the rights of others.
• Attempt to gain unauthorised access to any part of the App or its underlying systems.
• Use the App in a way that could impair its performance or disrupt other users' experience.
• Reverse engineer, decompile, or disassemble any component of the App.
• Use the App for any advertising or commercial solicitation without our authorisation.

6Your Personal Data & Privacy

Your privacy matters to us. We collect and process personal data — including health data and information relating to your child — in accordance with the Personal Data Protection Act No. 9 of 2022 (PDPA) of Sri Lanka.

The types of data we collect include identity data, contact data, health data (such as kick tracking, contraction timing, and weight inputs), demographic data, and app usage data. For a full explanation of what we collect, why, and how long we retain it, please refer to our Data Protection Notice.

We collect certain mandatory consents from you at registration, including consent for the use of health data for personalised app features and consent for profile creation and milestone tracking. Optional consents cover matters such as promotional communications, analytics, and feedback surveys.

You have rights under the PDPA including the right to access, rectify, erase, and object to processing of your personal data. To exercise these rights, contact us at support@babypedia.lk.

7Cookies & Tracking Technologies

The App uses SDKs, device identifiers, and similar tracking technologies — including Google Analytics for Firebase and Mixpanel — to support app functionality, analytics, and personalised content. Essential technologies are enabled by default. You may manage preferences for non-essential technologies through your device settings.

8Community Features & User-Generated Content

Babypedia includes community features such as Due Month Groups and Birth Month Groups. When you participate in these features, you agree to:

• Treat other members with respect and courtesy.
• Not post content that is harmful, misleading, offensive, or that violates the rights of others.
• Not share personal medical information about third parties without their consent.

By submitting content to the App, you grant Hemas Consumer Brands a non-exclusive, royalty-free, worldwide licence to use, reproduce, and distribute that content for the purposes of operating the App and associated services. We reserve the right to remove any user-generated content that violates these Terms.

While Hemas reserves the right to monitor community groups, it does not assume the obligation to do so. Hemas is not responsible for the accuracy or safety of advice shared by users in peer-to-peer forums.

9Third-Party Services & Links

The App may include links to or integrations with third-party services, including the Hemas shop and external healthcare resources. We are not responsible for the content, privacy practices, or terms of any third-party service. We encourage you to review the terms and privacy policies of any third-party services you access through the App.

Third-party service providers used in connection with the App — including push notification services, analytics providers, and cloud storage providers — are bound by contractual obligations to handle your data appropriately.

10Intellectual Property

All content, materials, design elements, logos, trademarks, and software within the App — including content relating to Baby Cheramy and the Hemas brand — are the property of Hemas Holdings PLC or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the App for personal purposes only. No rights or licences are granted beyond what is expressly stated in these Terms.

11Limitation of Liability

To the fullest extent permitted by applicable law, Hemas Holdings PLC, its subsidiaries, affiliates, officers, directors, and employees shall not be liable for:

• Any indirect, incidental, consequential, or special damages arising from your use of the App.
• Any reliance placed on health information or content provided within the App.
• Any interruption, suspension, or discontinuation of the App or its features.
• Any loss of data or unauthorised access to your account resulting from circumstances beyond our reasonable control.

Hemas Consumer Brands provides the App on an "as available" basis and does not warrant that the App, its features, or its underlying servers will be uninterrupted, secure, or error-free at all times. While we strive to maintain a consistent user experience, we do not guarantee one hundred percent (100%) uptime. Access to Babypedia may be suspended temporarily and without notice in the case of system failure, necessary maintenance, repair, or for reasons beyond our control. To the fullest extent permitted under the laws of Sri Lanka, Hemas shall not be liable for any loss of data, missed pregnancy milestones, or inability to access health tracking tools resulting from such service interruptions or Force Majeure Events.

12Indemnification

You agree to indemnify and hold harmless Hemas Holdings PLC and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your breach of these Terms, your use of the App, or your violation of any applicable law or third-party rights.

13Account Deletion & Termination

You may delete your account at any time through the Settings section of the App or by emailing us at support@babypedia.lk. Upon deletion, your personal data will be retained for a maximum period of 12 months for dispute resolution, security, and audit purposes, after which it will be permanently deleted or anonymised in accordance with our Data Protection Notice.

Hemas reserves the right to deactivate or archive accounts that have been inactive for a period exceeding 3 months, subject to prior notification to your registered email address.

We reserve the right to suspend or terminate access to the App where a user has breached these Terms, engaged in misuse, or where we determine such action is necessary to protect the integrity of the App or other users.

14Changes to the App & These Terms

We may modify, update, or discontinue features of the App at any time. We will make reasonable efforts to communicate material changes in advance. These Terms may be updated from time to time; the current version will always be available within the App under Settings > Terms of Use. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

15Governing Law & Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising in connection with these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
